Asheville -- March 26, 2024: Asheville Police Department Press Release:  A Candler man has been charged in

connection with a deadly collision near the intersection of Smokey Park Highway and Acton Circle that occurred on March 21, 2024.

Upon completion of the Asheville Police Department's investigation, along with consultation with the Buncombe County District Attorney’s Office, criminal charges were brought forth on John Terrell Foulk (01/05/1967) for Misdemeanor Death By Motor Vehicle and Failure To Yield when making a left turn.
Foulk was located and arrested on March 22, for the above charges. He was booked into the Buncombe County Detention Facility and released on a $5,000 unsecured bond.

APD News Release-Fatal Thursday Evening Motor Vehicle Collision

(March 22, 2024)Asheville Police Department Patrol officers are continuing to investigate a fatal motor vehicle collision that occurred Thursday evening at the intersection near Smokey Park Highway and Acton Circle.
APD patrol officers responded to a motor vehicle collision with injury near the intersection of Smokey Park Highway and Acton Circle around 6:13 p.m. on March 21. The preliminary investigation indicates a 2016 GMC Sierra truck traveling east on Smokey Park Highway attempted to turn left onto Acton Circle.

At the same time, a Hyundai Accent sedan operated by Larry Gaither Brooks (12/31/1932) was traveling west on Smokey Park Highway. The GMC Sierra turned left and impacted the Hyundai Accent. Also in Mr. Brooks’ vehicle were his son and daughter. Subsequently, the Hyundai Accent made contact with a 2010 Nissan Titan truck.

The driver of the 2016 GMC was uninjured. Sadly, the driver of the Hyundai, Larry Gaither Brooks, succumbed to his injuries on the scene. Mr. Brooks’ next of kin have been notified. Both passengers with in the Hyundai were transported to Mission Hospital for treatment, and one remains in critical condition. The driver of the 2010 Nissan Titan was uninjured.
