Boone -- April 11, 2022: In Wake County Superior Court on Wednesday, a Boone businessman pled guilty to felony tax charges brought by the North Carolina Department of Revenue. On April 6, 2022, Newland resident William David Gindlesperger, 58,

pleaded guilty to two charges of Embezzlement of State Property and two counts of Attempt to Evade or Defeat Tax.

Gindlesperger was sentenced by Wake County Superior Court Judge Paul Ridgeway to a 16-month minimum sentence and a 29-month maximum sentence for two counts of Embezzlement of State Property, as well as a 6-month minimum sentence and a 17-month maximum sentence for two counts of Attempt to Evade and Defeat Tax. The sentences were suspended, and Gindlesperger was sentenced to 36 months of supervised probation. Gindlesperger was ordered to be placed under electronic home monitoring for 60 days, pay a $2,000.00 fine, and complete 100 hours of community service as part of his probation. Prior to the plea, Gindlesperger paid $148,291.30 in restitution.

According to evidence given in court, William David Gindlesperger, the owner of Curiosity Consignment, embezzled, misapplied, and converted $148,291.30 in North Carolina sales tax to his personal use between August 1, 2014 and December 31, 2018. Gindlesperger was the responsible person of the business at this time, and he was responsible for collecting, holding in trust, and remitting North Carolina Sales Tax to the North Carolina Department of Revenue.

Gindlesperger knowingly filed false and fraudulent North Carolina Individual Income Tax Returns for tax years 2016 and 2017 that understated his taxable income in an attempt to evade and defeat the imposition and payment of North Carolina Individual Income Tax, according to additional evidence presented.

Gindlesperger was charged following an investigation by special agents from the Department's Criminal Investigations Division in Raleigh, and was prosecuted by the Attorney General's Special Prosecutions attorneys.
